The HardAssets World Wide Web site, located at the internet address of http://www.HardAssets.com is provided to you as is.  The copyright owner, employees, and/or contractors of HardAssets, will not be held responsible for any ad content, claims, outcome, or results of any or all ads, as well as the results of any defects that may be found to exist or any other consequential damages that may result from using our services directly or indirectly.  The copyright owner, employees, and/or contractors of HardAssets, disclaim any and all product warranties or guarantees, stated or implied, within each and all ads and features to the fullest extent of the law.

General Policies:
By using this service, you are allowing your information to be posted to a publicly available web page.  You must be eighteen (18) years old to place an ad or otherwise engage in any transaction on HardAssets Classifieds.  HardAssets provides Classifieds as a platform for our users to connect with one another. HardAssets does not participate in, nor is it a party to, any Classifieds transactions. Sellers and buyers are responsible for all aspects of the transactions in which they choose to participate.  HardAssets does not screen or control users who may sell or buy on Classifieds, nor does HardAssets review or authenticate all listings, items, or services offered for sale. Therefore, users of this service should be aware of the following:
• Sellers and buyers are completely responsible for working out the sale and exchange of goods or services.
• Sellers and buyers must resolve any disputes that may arise from Classifieds transactions.
• It is important to use care throughout your dealings with other people in HardAssets Classifieds.
• Sellers and buyers are responsible for all applicable taxes and for all costs incurred by participating in HardAssets Classifieds.
• Sellers and buyers are responsible for researching and complying with any applicable laws, regulations or restrictions on items, services, or manner of sale or exchange that may pertain to transactions in which they participate.

Run Length and Early Removal:
Free ads will be displayed for 60 days.  Paid ads will be displayed indefinitely.  You may select how long you want your item to be listed in the Classifieds. We have provided a mechanism (via your email address and your personal password) for you to remove your item earlier in case it is sold or no longer available. If you are having trouble with your password, please send a message to the HardAssets Classifieds Department (mailto: classifieds@hardassets.com), and we will remove the item for you. You may re-post your item at the end of the requested run length if it is not sold, or if you would like it to be listed again.  Once an ad is "sold", it will continue to be displayed for another 30 days, accompanied by a graphic indicating that the item is no longer for sale.

Hold Harmless:
Advertiser accepts all liability for the content of all advertising supplied by it.  Advertiser warrants to HardAssets that its copy is true, that it is not libelous or defamatory, that it violates no rights of privacy, that it infringes no trademark, and that it complies with all applicable federal, state, and local laws and regulations. The fact that copy shall have been previously submitted to HardAssets for approval and shall have been approved by it either in whole or in part, shall not relieve Advertiser of the warranty. Advertiser agrees to defend, indemnify and hold harmless HardAssets from any and all claims, demands, liabilities, suits, costs, or expenses, arising by reason of the publication of Advertiser's advertisement or breach of the foregoing warranty, whether such claims are well-grounded or not.

Fraud:
You may not use or manipulate this service for any fraudulent activity or purpose, including collecting payment from buyers and not providing the item or service purchased, or filing false claims for insurance payments.  You may not offer any item for sale that is not in your possession, that you do not have the right to sell, or that does not exist at the time of the ad.

Interference:
You may not spam our system and/or impose an unreasonably or disproportionately large load on our system. You may not put any material on HardAssets Classifieds that contains any viruses, Trojan horses, worms, time bombs, cancel bots, or other computer programming routines that may damage, interfere with, surreptitiously intercept, or expropriate any system, data, or personal information. You may not solicit HardAssets Classifieds users to post ads on other classifieds sites.  You may not post an ad through unauthorized robots (crawling software).  We make every effort to print only those ads deemed credible. We reserve the right to revise, edit or reject any or all copy.

Inappropriate ad content:
You may not link to, post, or include advertisements for goods or other materials that describe items or services that you are not selling in HardAssets Classifieds. You also may not include any content that is obscene, offensive, harmful to minors, invasive of anyone’s privacy, or otherwise inappropriate. HardAssets reserves the right to modify your ad, if necessary, to remove content which is not in compliance.
1. Profanity: Should the title, description, URL or any other content of your ad contain words that are offensive or profane, the ad will be rejected.
2. Irrelevance: If the content of an ad or the web site to which it links is contextually irrelevant to the category in which it is listed, then that ad will be rejected.
3. Sexual Content: If the content of an ad or the web site to which it links is pornographic or sexually offensive, the ad will be rejected.
4. Illegal: Any ad that promotes products and/or services deemed to be illegal or unethical will be rejected.

HardAssets reserves the right to censor, reclassify, revise, edit, or reject any advertisement not meeting its standards of acceptance.  Submission of advertisement to a HardAssets sales representative does not constitute a commitment by HardAssets to publish the advertisement.  Publication of an advertisement does not constitute an agreement for continued publication.  Please be advised that to maintain quality customer service, HardAssets does randomly monitor telephone transactions.

Errors and Corrections:
HardAssets will not be liable for failure to publish an ad as requested or for more than one incorrect insertion of an advertisement.  If any part of the posting must be edited/corrected after you have submitted it, please send a message indicating the correction to the HardAssets Classifieds Department (mailto: classifieds@hardassets.com).  HardAssets liability for damages resulting from errors in any advertising that it publishes or from its failure to publish any advertisement that it has agreed to publish shall be limited to the amount it actually received in consideration for its agreement to publish the advertisement in question.  HardAssets shall not be responsible for any special, incidental or consequential damages suffered by any party resulting from its errors or omissions.  The Advertiser must report such errors or omissions within seven days of the publication dates.  In the event of an error, or omission in publication of an advertisement, HardAssets' liability shall be limited to an adjustment for the cost of the space occupied by the error, with maximum liability being cancellation of the cost of the first incorrect advertisement or republication of the correct advertisement.  Under no circumstances shall HardAssets be liable for consequential damage of any kind.

Listing Information:
Ads are billed by character.  Normal punctuation is required in all ads, including spaces between words, and commas. We will punctuate and abbreviate your ad, if needed.  Please do not forget to tell the reader how to contact you.  If your ad text does not have adequate contact information, we will automatically include your billing Email address in your ad.  Remember that pricing your items is required.  Place item in the appropriate category. You must list your item in the most appropriate category. Each item cannot be listed in more than two categories.

By placing an advertisement with HardAssets you agree that the advertisement as it appears on HardAssets will become the property of HardAssets and you will assign all ownership interest in the advertisement as it appears on HardAssets under the Copyright Act or otherwise to HardAssets.

Rates and specifications are subject to change.  HardAssets reserves the right to, at any time, revise the design, look and feel and layout of the HardAssets web site.  If any such revision would result in the need to modify placement of your ad, we may, in our discretion, move your ad to a comparable placement for the remainder of your campaign and you will not be entitled to any refunds of funds paid.  We will make every effort to schedule your ad as soon as possible; however, it may take up to 2 business days.  All ads will be acknowledged.

Security:
This site has security measures in place to protect the loss, misuse, and alteration of the information under our control. All member data and activity is stored separately and is not directly accessible through a web browser. We use industry standard procedures and processes to safeguard the confidentiality of your identifiable personal information, such as firewalls, encryption, token authentication, monitoring technology, and adaptive analysis of network traffic to track abuse of our network and its data.

Prohibited Listings:
Sellers and buyers are solely responsible for ensuring that the items or services listed for sale and bought by users are appropriate for sale under all applicable laws and regulations.  Please submit a letter to the Classified Director anytime the offer implied differs from the actual offer (mailto: classifieds@hardassets.com).  We want our users to have a safe experience. By using HardAssets, you agree that you will not list or sell the following items or services under any circumstances:

1. Any item or service that is harmful to minors, obscene, or otherwise objectionable
2. Firearms, ammunition or accessories, including, without limitation, scopes and silencers
3. Switchblade knives, martial arts weapons or other concealed weapons
4. Explosive devices (or equipment to construct one) or material, including, without limitation, fireworks or other hazardous materials or chemicals.
5. Illegal drugs, drug paraphernalia (including items to grow, manufacture, or distribute drugs), prescription drugs and medical or other prescription devices
6. Cigarettes (and other tobacco products) and alcohol
7. Items, goods or services that violate any international export law or regulation, including any items subject to the terms of any international embargo
8. Items that infringe the rights of a third party, including items that violate copyrights, trademarks, publicity or privacy rights of third parties
9. Stolen or counterfeit goods.
10. Lock picking materials and devices.
11. Hate material, including without limitation, any material that promotes, glorifies, or is directly associated with groups or individuals known principally for hate or hate speech or violent positions or acts. Items associated with groups or individuals known principally for their hateful or violent positions are prohibited. Expressive media, such as books and films, may be subject to more permissive standards as determined by HardAssets in its sole discretion
12. Any animal, live or otherwise, that are subject to regulations or laws, including endangered species and domesticated animals, as well as any items made from or including any parts of an animal protected by law or regulation. Domesticated pets may be offered for sale or adoption on HardAssets.
13. Any item that has been the subject of a product recall by a government agency or product manufacturer
14. Any item used for hacking, intercepting, jamming, descrambling or otherwise obtaining unauthorized access to wire, electronic, cable or other types of communications and transmissions
15. Human parts, remains and bodily fluids
16. Government-issued identification documents or IDs, police badges or insignia, and any other law enforcement items (e.g., badges, uniforms, flashing lights/sirens, etc.)
17. Stocks and securities
18. Listings constituting solicitations to commit criminal activity
19. Gambling items, including, without limitation, lottery tickets, sweepstakes, pyramid schemes, grab bags, raffles and slot machines
20. Individual contracts, services, and any item that is non-transferable
21. Event tickets sold for prices that are in violation of the laws or regulations of the event venue.
22. Non-packaged food items and other food or beverage items regulated by applicable legal regulations
23. "Adult oriented" products or services, as determined in HardAssets sole discretion
24. Bulk email lists and other mailing lists
25. Child adoption solicitations and offers
26. Listings solely for the purpose of soliciting or raising money without selling goods or services in exchange
27. Term papers, thesis papers, dissertations, and book reports
28. Any other item or service that violates any applicable local law or regulation or which HardAssets determines, in its sole discretion, is inappropriate for sale through the services provided by HardAssets.
This list may be amended and modified at any time by HardAssets in its sole discretion and HardAssets reserves the unrestricted right to reject, cancel or remove any ad for any reason at any time.
